Customer and Island Enterprises Inc., (hereinafter IE) agree:

Your purchase of the above reference tour(s) constitutes acknowledgment and agreement of the below provision.

This Transaction Receipt confirms customers purchase of the above reference tour(s) provided by IE during their visit on Santa Catalina, Island, California. The Transaction Receipt must be presented to a CAT ticketing booths located at the Cabrillo Mole, Green Pleasure Pier or Yellow Ticket Booth at least 30 minutes prior to the departure time of the tour for processing of customer's boarding ticket for each tour. See map page 3 for directions.

Customer understands that they are responsible for their own transportation (air or water) to Santa Catalina, Island, County of Los Angeles, California. For information on transportation to and from Santa Catalina, Island please call 877-510-2888 (9am-5pm PST, M-F)

There are NO cancellations or exchanges. A fee of 25% of the tour ticket purchase price will be charged for any itinerary changes, subject to availability.

All prices shown are quoted in U.S. dollars per person and do not include U.S. Government, State and/or local Taxes and Fees. Exact price depends upon selected tour, date and departure time. All offers are capacity-controlled. May not be combinable with other offers. Prices do not include any and all outside ticketing service fees, Credit Card processing fees. Tour price plus all Taxes and Fees paid by Customer are listed on the Customer Internet Receipt and on the Customers Boarding Pass. (Non-Internet Customers) Tour price plus all Taxes and Fees paid by Customer are listed on your Boarding Pass and are available at the ticketing counter prior to purchase. A condition of entry upon any tour offered by IE is that CUSTOMER ASSUMES ALL RISK OF PERSONAL INJURY regardless of cause, including any injury caused by the negligence of CAT or its employees or agents. Personal INJURY CAN AND MAY OCCUR.
All customers AGREE to COMPLY with CAT's staff directions, rules and regulations not limited to the contents of this specific agreement and further understand that due to IE's ongoing aggressive safety management program, these rules and regulations may be modified or changed during the course of an operating season or specific tour. It is essential that each guest, regularly familiarize themselves with current rules, regulations and policy.

Use care as paved surfaces, wooden, pier decks and other common areas may become slippery and may move.

Outside food, beverages, bottles, cans, ice chests and coolers are NOT allowed in or on any tour whatsoever. Picnic areas are located around the City of Avalon.

This Transaction Receipt or any tour ticket(s) obtained therewith is/are nontransferable.

Due to the exceptional rate for all combination tours, if for any reason a refund is provided for the tour that was not taken, it will be charged at the regular rate and the difference will be refunded to customer.

All tours are subject to change or cancellation due to weather conditions. If a tour is canceled for any reason, CAT will provide customer with a "no-cash-value" voucher valid for 1 year from the ticket purchase date. If, in the sole discretion of IE, IE will make a refund to the ticket holder by the same means it which the ticket was purchased, i.e., credit card purchase refunded to same credit card, cash purchase refunded in cash, etc. If a tour is canceled completely, then price value of tickets will be refunded ONLY if tickets are returned within 10 business days of cancellation or notification of cancellation. If a tour is postponed, tickets are still valid and therefore must be used on the new date.

The laws of the State of California shall govern this Agreement and the parties hereto irrevocably agree to adjudicate to the jurisdiction of the Superior Court of California, for the County of Los Angeles, in the City of Long Beach, for any disputes arising from this Agreement. In the event legal proceedings of any nature are instituted hereon, or hereunder, by reason of any dispute arising out of the terms of this Agreement or the enforcement of this Agreement, or any part hereof, the prevailing party in any such proceeding shall be entitled to receive reasonable attorneys' fees and legal costs incurred in such action or other proceeding.

All tours provided by IE through its web site located at (www.catalinaadventuretours.com) are serviced through Seat Advisor, Inc. All fees and credit charges incurred by customer related to their tour purchase through Seat Advisor, Inc. are non-refundable.

The license granted by this Transaction Receipt and/or Boarding Ticket is for the purpose of viewing the tour(s) purchased as an eyewitness. IE may eject any person using it for other purposes and IE reserves the right to seize the receipt/ticket and cancel it without compensation if altered or misused. Transaction Receipts and/or Boarding Tickets obtained from sources other than IE authorized ticket booths may be lost or stolen tickets and in such cases will not be honored.

WARNING
Please be alert at all times when entering or exiting boats, buses, trams, semi-submersible submarines, etc. Inappropriate attire, including but not limited to, high heel shoes, platform shoes, restrictive clothing can cause serious injury. Customer is responsible and must wear appropriate attire based on the tour conditions. IE reserves the right to deny access to its tours to individuals who refuse to obey tour rules or personnel.

If injured, notify tour personnel immediately for directions to medical assistance. The holder of this Transaction Receipt and/or Boarding Ticket assumes all risks and danger of personal injury and all other hazards arising from or related to in any way the tour for which this Transaction Receipt and/or Boarding Ticket was issued whether occurring prior to, during, or after the tour. The holder agrees that all people and entities related to this tour are expressly released from claims arising from such causes.

Even though great care is taken by CAT personnel to provide a safe and secure tour, tours such as the "Inside Adventure Tour" utilize unpaved roads to gain access to the interior of Santa Catalina Island. These roads may have unforeseen potholes, which can cause the tour buses to bounce violently. Pregnant women, persons with heart conditions, high blood pressure or individuals with bone, skeletal, back injury or other medical conditions or the infirm should not take this tour.

I (WE) ACCEPT THIS AGREEMENT WITH A FULL UNDERSTANDING THAT I, (WE), ALONE AM RESPONSIBLE FOR ANY PERSONAL INJURY THAT MAY OCCUR INCLUDING INJURY CAUSED AS A RESULT OF NEGLIGENCE OF CAT OR ITS EMPLOYEES OR AGENTS TO MY SELF OR OTHER PERSONS THAT MAY BE INCLUDED ON THIS INVOICE. IF THESE TERMS ARE NOT ACCEPTABLE, I UNDERSTAND THAT I MAY CHOOSE NOT TO ENTER THE TOUR OR EXCURSION AND WILL BE PROVIDED A FULL REFUND EXCEPT FOR THOSE NON-REFUNDABLE FEE(s) SET FORTH ABOVE. THAT AFTER THE TOUR OR EXCURSION HAS BEGUN, THE REFUND POLICY IS VOID. I (WE) FURTHER ACKNOWLEDGE THAT THE ACT OF TAKING PART OF ANY TOUR OR EXCURSION PROVIDED BY CAT SHALL BE DEEMED AN ACCEPTANCE OF THE TERMS OUTLINED ABOVE.
